The RoHS Directive 2011/65/EU (Art. 24) stipulates: General review by the EU Commission, submission of a report and, if necessary, a legislative proposal to the EU Parliament and the EU Council. Commission proposal of December 7, 2023: Transfer of responsibility for the technical evaluation of temporary exemptions and the process of reviewing the list of restricted substances to the ECHA. The “one substance, one evaluation” concept will be followed. Objective: Limited amendment of the RoHS Directive. Decisions on amendments to the relevant annexes to the Directive would continue to be taken by the Commission by means of delegated acts. There are also plans to revise the FAQ document.

Regulation (EU) 2023/1542 (EU Battery Regulation) came into force on August 17, 2023 and will replace the current EU Battery Directive 2006/66/EC on August 18, 2025. The EU Battery Regulation is relevant to both batteries as products and waste batteries.

On 08.05.2024, the Federal Ministry for the Environment presented a draft to adapt German battery legislation to the EU Battery Regulation. This was adopted by the Federal Cabinet on 06.11.2024 but not dealt with by the Bundestag. As the Bundesrat did not issue a statement and the draft was no longer discussed, it was subject to substantive discontinuity and had to be reintroduced on 27.05.2025. The law is intended to implement the necessary national regulations to implement the EU Battery Regulation. In this context, the previous German Batteries Act (BattG) is to be replaced by the Battery Law Implementing Act (BattLIA). The draft law addresses the need to adapt national law. It defines the national competent authorities and their powers for certain areas. In addition, the nationally established structures for waste portable batteries will be continued in the area of waste management and extended to other categories.

As one of the main causes of climate change, the European Union (EU) is targeting deforestation, which is responsible for the loss of habitats and the emission of greenhouse gases. The regulation aims to minimize global deforestation through exported products and to maximize the demand for deforestation-free products, which are listed in Annex I of the law, classified by commodity code. This annex is to remain flexible, i.e. it can still be adapted or changed by the EU Commission. The listed raw materials include cattle, cocoa, coffee, oil palm, rubber, soy and wood, as well as certain products made from these, which are listed in Annex I.

The CSRD (EU 2022/2464 "Corporate Sustainability Reporting Directive"), which the EU Commission launched on 21.04.2021, doesn't only affect large public interest entities (PIEs), but all large corporations are obliged to report on their social and environmental activities if they meet at least two of the following three criteria: over EUR 25 million in total assets, over EUR 50 million in turnover and/or over 250 employees. In addition, listed SMEs and companies from third countries with an EU subsidiary and a turnover of at least 150 million euros also fall within the scope of application.

ATTENTION: The EU Omnibus I initiative (publication on 26.2.2025) could reduce obligations regarding CSRD and raise the user thresholds.

The first omnibus package (the so-called Sustainability Omnibus) includes amendments to the Corporate Sustainability Reporting Directive (CSRD), the Corporate Due Diligence Directive (CSDDD) and the Carbon Border Adjustment Mechanism (CBAM). The package is accompanied by a draft delegated act on the taxonomy, which is open to public consultation. The aim is to reconcile the EU's pursuit of a sustainable transition with improving the competitiveness of EU companies.
